Common Law (Landlord-Tenant)

A common-law (and in most states statutory) doctrine that residential leases include an implied promise that the premises are fit to live in — adequate heat, water, sanitation, and structural safety. Breach may allow the tenant to withhold rent, repair-and-deduct, or terminate, subject to state procedures.
